You’, ‘your’ or customers refers to a potential or actual client of Lavish. “Partner” in these Terms and Conditions refers to a Salon or Spa.

The content of this site is provided by Lavish. Lavish accepts no liability for any statement, inaccuracy or omission on this site. Lavish accepts no liability for any direct, special, indirect or consequential loss or damages of any kind resulting from the use of any information obtained directly or indirectly from this site or for any viruses that may infect your computer equipment or other property on account of your access to, use of, downloading of or browsing in this site. All such liability is excluded to the fullest extent permitted by law. The information on this site is subject to change and may be amended or withdrawn at any time without notice. These Conditions of Use may be changed at any time without notice. All Partners, and Partner Specific Vouchers shown on the Website are subject to availability and the images and/or descriptions of the Services on the Website are for illustrative purposes only and actual Services may vary from those images and/or descriptions. We require our Partners to ensure that all information provided by them for display on their page of the Website is a fair representation of the facilities and services, and not misleading in any way but we cannot verify the information which they provide to us. Use of information provided to Lavish.
All information collected by Lavish is stored and handled in accordance with the Data Protection Acts (1984 and 1998). Personal and financial information collected on this site is used for the sole purpose of processing and delivering your order. During registration you will be invited to “opt in” to receive information from Lavish. Financial and payment details such as credit/debit card numbers are removed from our database immediately following payment. Please note: Posting or transmitting any unlawful, threatening, defamatory, obscene or other inappropriate material is prohibited. These terms and conditions and anything in this site shall be governed by English Law and all matters in connection with them shall be determined by the English Courts.

Gift Voucher Terms and Conditions
Lavish Gift Vouchers are managed by Gifted To You Ltd We retail two types of Lavish Gift Vouchers i) Monetary Value Vouchers ii) Partner Specific Vouchers All vouchers are valid for 12 months from the date of activation. Unless the voucher is purchased for a specific promotional offer, then a different term of validity may apply. We offer two types of delivery method i) Digital Evouchers delivered by email ii) Physical vouchers delivered by post. Evouchers will be transmitted electronically once payment has cleared and then, just like a physical voucher, it is the purchaser’s and recipient’s responsibility. Prior to purchase we ask the purchaser to confirm the recipient’s email address. We cannot be held responsible for incorrectly emailed, lost, stolen or deleted Evouchers; although we recommend you contact us for help if you are experiencing any difficulties. From time to time Evouchers can get caught up in spam filters and it is up to the recipient to check these filters. We do not take responsibility for Evouchers that cannot be delivered to the recipients email address because of spam filters, firewalls, capacity of the recipient’s mailbox or any other factors outside our control. It can take up to 24 hours for an Evoucher to be activated. Physical vouchers purchased with First Class Signed for option are not covered if they are lost in the post, or the incorrect address information is supplied, but in special circumstances may be replaced at our sole discretion. Physical vouchers purchased with Next Day Delivery will be dispatched using a secure courier. It is a trackable and insured service and vouchers will be replaced by us if they have not been delivered and have not been used. Physical vouchers purchased with Saturday Special Delivery includes Royal Mail cover, it is a trackable and insured service vouchers will be replaced if they have not been delivered and have not been used. Lavish is not responsible for loss, damage, theft or expiration of vouchers – they cannot be replaced. Vouchers stolen will not be replaced by us.
Using Monetary Value Lavish Vouchers
Monetary Value Vouchers can only be used at a participating Lavish Partner. These can be found detailed in the partner listings directory on line. Please note that the list of Lavish Voucher Partners is constantly evolving and may vary from time to time. If you wish to ensure that you or the person that has received the Lavish Voucher can use it at your preferred location listed on the website at the time of purchase, it should be exchanged as soon as possible after purchase . Customers should state their intention to redeem a voucher when making an appointment with a participating Lavish Partner and should present the voucher to the Lavish Partner on arrival. Lavish Gift Vouchers cannot be exchanged for cash. Lavish Gift Vouchers can be exchanged for goods or services of a higher price than the face value of the voucher on payment of the difference. Lavish make no warranty regarding any goods or services that are received in exchange for a Lavish Gift Voucher. If the total value of the voucher is not redeemed, it is at the sole discretion of the partner as to whether a credit note or cashback is given.
Using Partner Specific Vouchers
Partner Specific Vouchers can only be used at the named Lavish Partner detailed on the physical or Evoucher. Please note that the list of Lavish Partners and the specific vouchers that they offer through the Lavish website is constantly evolving and may vary from time to time. If you wish to ensure that you or the person that has received the Partner Specific Voucher can use it at your preferred location listed on the website at the time of purchase, it should be exchanged as soon as possible after purchase. Customers should state their intention to redeem a voucher when making an appointment with a participating Lavish Partner and should present the voucher to the Lavish Partner on arrival. Lavish Gift Vouchers cannot be exchanged for cash. Lavish Gift Vouchers can be exchanged for goods or services of a higher price than the face value of the voucher on payment of the difference. Lavish make no warranty regarding any goods or services that are received in exchange for a Lavish Gift Voucher. The total value of the voucher must be redeemed at the partner specific location.
Voucher Expiry and Extension
All Vouchers show an expiry date on them. Lavish partners will not accept Lavish vouchers that are past the expiry date shown on the voucher. Failure to exchange or redeem a Lavish voucher at one of the spas listed at www.lavish.co.uk before the expiry date will invalidate the Lavish voucher. If you are unable to use your voucher before this date, please contact us at firstname.lastname@example.org before the voucher has expired, we maybe able to arrange a voucher extension. Vouchers can only be extended if they are within their expiry date. For the replacement of physical vouchers, we will ask that you send the voucher to us, in its original packaging, so that we can then issue a new voucher to you. All physical voucher extensions are subject to an administration fee of £25.00. Once a voucher has been extended it cannot be refunded. For the replacement of digital vouchers we will ask that you email the voucher back to us so that we can confirm it is fully cancelled and then issue a new digital voucher to you. Once a voucher has been extended it cannot be refunded. The funds on a gift voucher are not covered by the Financial Services Compensation Scheme. In the unlikely event of the issuer of this product becoming insolvent funds on the voucher may not be available to spend.
Clients have the right to return any goods or vouchers within 7 days of receipt for a full refund or exchange. All refunds or exchanges made after 7 days and within 28 days of receipt will incur a £20 or 20% administration charge (whichever is greater). Once an appointment has been made with a Salon or Spa the Client is bound by their Terms and Conditions. All refunds will be made to the person who purchased the voucher and the monies will be refunded directly to the payment card that was used to make the purchase. To request a refund for a physical voucher you must return your complete voucher pack in its original packaging by recorded delivery to Lavish, Customer Services, Bywater House, Lymington, SO41 5SB along with a covering letter detailing the reason for your refund request. To request a refund for a digital voucher you must return the original digital copy to email@example.com so that it can be checked and cancelled.
Competition/Prize Draw Terms & Conditions
The Lavish Free Prize Draw is open to anyone and no purchase is necessary. Entry into the prize draw is automatic and is made by completion and submission of email contact details on the website. Only one entry is permitted per email address, although an individual may enter more than once by submitting multiple different email addresses. Entrants must be 18 or over or obtain parental or guardian consent and be a resident in the UK. Competition entries must be made in the manner and by the closing date specified on the Competition Notice. Failure to do so will disqualify the entry. All entries must be received by 12:00 (GMT) on the final day of the prize draw. One prize winner will be selected in a random draw and will be notified by email within 21 days of the closing date specified in the prize draw. The prize is a Lavish gift voucher, the denomination may change dependent on the terms of competition the voucher can be used in full or part payment for any treatment at any of the spas and salons listed with Lavish. Prices for treatments vary from location to location so please discuss with the individual spa or salon to find out more information. There is no cash or prize alternative available and the prizes are not transferable and cannot be used in conjunction with any other offer. Persons directly or indirectly involved with this promotion, including employees of Gifted To You Ltd or immediate family members are not eligible to enter. This competition has been organised by the promoter Gifted To You Ltd The decision of Gifted To You Ltd is final and no correspondence will be entered into. Receipt of entries will not be acknowledged. Gifted To You Ltd reserves the right to withdraw amend or alter the offer and this promotion at any time. This promotion will be governed by English law. All entrants agree to be bound by these terms and conditions.
Data Processing Policy
Under the newly introduced GDPR requirements we have an obligation to implement technical and organisational measures to show that we have considered and integrated data protection into our processing activities.
What we need
We only collect personal data about you which enables us to fulfil your gift order. It does not include any special types of information or location-based information. This does however include your name, delivery address, email and in some cases your contact number.
Why we need it
We need to know your basic personal data in order to provide you with our gifting services and provision of services in line with contractual agreements with our channel partners and suppliers. We will not collect any personal data from you we do not need in order to provide and oversee this service to you.
What we do with it
All the personal data we process is processed by our employees who are based in the UK. However, for the purposes of IT hosting and maintenance this information is located on servers within the European Union. No 3rd parties have access to your personal data unless the law allows them to do so.
We have a Data Protection regime in place to oversee the effective and secure processing of your personal data.
How long we keep it
All data provided is for purpose of gift fulfilment and is destroyed after 30 days, or sooner if the gift is dispatched and confirmation is received of its receipt. No further contact will then be made.
What are your rights?
If at any point you believe the information we process on you is incorrect you can request to see this information and even have it corrected or deleted. If you wish to raise a complaint on how we have handled your personal data, you can contact our Data Protection Officer who will investigate the matter.
If you are not satisfied with our response or believe we are processing your personal data not in accordance with the law, you can complain to the Information Commissioner’s Office (ICO).
